Welcome to Brutal Learning. These Terms and Conditions (“Terms”) govern your access to and use of the Brutal Learning website located at test.ratioci.in (the “Website”), our mobile application (the “App”), and all associated backend services and APIs (collectively, the “Service”).
Brutal Learning is owned and operated by Himanshu, based in Uttar Pradesh, India, under the Brutal Learning/RatioCI brand. By accessing, registering for, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
These Terms, together with the Privacy Policy, Refund Policy, and any other policies expressly incorporated by reference, constitute the entire agreement between you and Brutal Learning concerning your use of the Service.
1. Description of Service
Brutal Learning is an educational technology platform designed to provide learning materials, test preparation, and user assessment tools. The Service includes, but is not limited to:
- Course Management: Enrollment and tracking of educational courses and subjects via the Website and App.
- Practice & Assessments: Access to normal practice sessions, revision modes, and mock tests.
- Performance Tracking: Dashboards, progress reports, daily missions, and leaderboards.
- Communication: In-app and on-site chat functionality to communicate with instructors or peers.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.
2. User Accounts and Security
To access certain features of the Service, you must register for an account.
- Eligibility: Users under 18 may use the Service only with the involvement and consent of a parent or legal guardian. Purchases made by or on behalf of a minor must be authorized by the parent or legal guardian.
- Account Creation: You agree to provide accurate, current, and complete information during the registration process, including verifying your account via One-Time Password (OTP) if required.
- Account Security: You are responsible for safeguarding your login credentials and for any activities or actions under your account across both the Website and the App. You must notify us immediately of any unauthorized use of your account.
- Account Termination: We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, or if you violate any provision of these Terms.
- Sesssion Management: For security and account-integrity purposes, an account may have only one active mobile-app session at a time. When a user verifies and activates a new device, the previous mobile-app session may be automatically revoked. Users must not share their account credentials or permit another person to access their account.
3. Payments, Subscriptions, and Entitlements
Certain courses, premium mock tests, or features within the Service may require payment.
- Pricing and Taxes: All prices listed on the App and Website are in Indian Rupees (INR) unless otherwise stated. Prices are subject to change without notice. Any applicable taxes will be calculated and displayed clearly at checkout.
- Billing: All payments are processed securely through our integrated third-party payment gateways. You agree to pay all applicable fees associated with your selected entitlements.
- Refund Policy: All sales are final and non-refundable unless expressly mentioned or required by law. Please refer to our dedicated Refund Policy for detailed terms.
- Entitlements: Purchasing a course or subscription grants you a limited, non-exclusive, non-transferable license to access the content for the duration of your active subscription or course lifecycle.
4. Shipping and Delivery Policy
Delivery of Digital Goods: As our Service provides digital educational content and mock tests, no physical shipping is required. Upon successful payment, access to the purchased courses or test series is granted instantly and automatically added to your user dashboard across both the Website and the App.
5. User Conduct and Acceptable Use
By using our Service, you agree not to:
- Cheat or Exploit: Use automated scripts, bots, or unauthorized tools to complete mock tests, manipulate leaderboards, or falsely complete daily missions.
- Reverse Engineer: Decompile, disassemble, or reverse engineer any part of the App, Website, source code, or the associated REST APIs.
- Misuse Chat: Transmit any harassing, defamatory, abusive, or spam messages through the communication systems.
- Infringe Intellectual Property: Copy, distribute, record, screen-capture, or pirate our question banks, course materials, or application assets.
- Account Sharing or Resale: share, sell, transfer, sublicense, or otherwise provide access to your account, paid courses, mock tests, subscriptions, or other paid entitlements to another person
- Assessment Integrity: use unauthorized assistance, automated tools, scripts, bots, multiple accounts, or other methods intended to manipulate test results, rankings, leaderboards, progress records, or other assessment outcomes. We may invalidate or remove assessment results, rankings, rewards, or progress obtained through cheating, manipulation, exploitation of bugs, or other prohibited activity.
6. Intellectual Property Rights
All original content, features, and functionality of the Service—including but not limited to the question database, course materials, text, graphics, logos, and software—are and will remain the exclusive property of Brutal Learning and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws of India.
Subject to these Terms and any applicable purchase or subscription conditions, we grant you a limited, personal, non-exclusive, non-transferable, and revocable right to access and use the Service for your own educational purposes. No ownership rights in our content or software are transferred to you.
7. Disclaimers and Limitation of Liability
A. Academic Disclaimer
The mock tests, practice sessions, and revision strategies provided by the Service are for educational and preparatory purposes only. We do not guarantee any specific outcomes, exam results, or academic achievements resulting from the use of our Service.
B. “As Is” Service
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties, either express or implied, regarding the reliability, accuracy, or continuous availability of the Service, including the seamless saving of test session data.
C. Limitation of Liability
To the maximum extent permitted by applicable law, Brutal Learning shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any unauthorized access to or use of our secure backend servers.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.
We will not be responsible for delay, interruption, or failure to perform our obligations where caused by events beyond our reasonable control, including natural disasters, governmental actions, internet or telecommunications failures, infrastructure outages, cyber incidents, or failures of third-party service providers.
8. Modifications to the Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be modified or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
9. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Etah, Uttar Pradesh, India.
